You should ensure that you have carefully read the information contained in these Terms & Conditions, bearing in mind that it will be directly applicable to this website and orders.

These conditions may change without notice. It is the customer’s responsibility to review it, as the conditions in effect at the time of use of the website are those that will apply. These terms and conditions may be viewed by your choice in any of the languages available on our website.

The articles presented on this website are available for National and International delivery, according to the underlying logistic conditions.

5. Orders

To place your orders on our website you must be logged in to the platform, according to the defined access data. If you are not registered, you need to register in order to access the content available on our Online Store.

Articles in the Online Store will be viewable according to article families/subfamilies. The arrangement of the articles can be defined according to the default order (alphabetically), by popularity, by recent articles or by ascending/descending price. Selected items should be placed in the “Shopping Cart”. Here you can add, change or remove any article.

Once you have made your purchase, all items you wish to purchase have been added to your “Cart” and the next step will be the completion of your order. For this purpose, the customer must verify and confirm all the constant data and submit their order. To the customer have the record of the order, you can send it to your email.

The delivery address of the ordered items will be that stated in the order form. If you would like to change delivery address, we appreciate your referral to the new address.

Once the order is placed and all the necessary checks are made by L. Pinto Monteiro, Lda, including the confirmation of the supply conditions, the customer will be contacted.

Shipping costs will be applied per order. However, for purchases of €250.00 or more, will not be charged costs for delivery to Portugal Mainland. The exact price of each shipment will depend on the weight/volume of your order. The transportation cost values show the legally established rates and taxes. For shipments to the Azores and Madeira as well as international destinations, shipping costs are under consultation.

Regarding product availability, and unless extraordinary circumstances occur, we will send your “Purchase Order” within 5 days (to Portugal Mainland). For shipments to Azores and Madeira as well as international destinations, delivery times will be defined case by case.
However, delays may occur for any of the following reasons:

  • Specialized articles;
  • Unforeseen circumstances;
  • Problems in the delivery zone.

We do not deliver on Saturdays, Sundays and holidays.

In order to receive your order, you must ensure that someone is at the address indicated, within the defined delivery period, from 09:00 to 19:00.

The invoice will accompany your order or may be sent by mail within 5 days after delivery.

The customer may modify or withdraw the order within 24 hours of its validation. For this purpose, the customer should contact us by email: [email protected]

    5.1. Tracking your order
    5.1.1 Shipping to your address

Check the status of your order at any time by sending an email to [email protected], entering your order number.

In addition, as soon as your order leaves our warehouses, we will send you an email or you will be contacted by telephone.

     5.1.2. Pick up at our facilities

If you have chosen to pick up your order in our warehouses, we will inform you by email or by telephone that your order is available to pick up, with a maximum of 5 days.

     5.2. I haven’t received my order yet

If you have not yet received your order and have previously received an indication that your order has been shipped, please contact us via email or telephone to verify the status of your order with the carrier.

     5.3. I didn’t receive all items from my purchase

If any item is not available for delivery, we will send you an email indicating the unavailable items. Once the article is available again for delivery, we will contact you for your validation.

All product orders will be subject to product availability. In this regard, if any difficulty occurs in the products supply or if there are no items available in stock, we will inform you immediately of their unavailability.

If you wish to place an order for Azores and Madeira, you will receive an email with the shipping costs, according to the customer’s commercial conditions.

The transit time of the order may be different than expected due to adverse factors to our activity, customs issues, delivery time on different islands, among others.

7.5. International shipping

If you wish to place an order for an International destination, you will receive an email indicating the agreed incoterms.

Your order will be subject to weight/volume taxation (length x width x height in cm3 or kg’s).

8. Inability to deliver

If your order is not delivered, you will receive a “Reception Notification”, which will indicate the procedure for it to be re-delivered. If you are not at the place of delivery at the agreed time, we kindly ask you to contact us or the carrier for a new delivery schedule.

Please note that if the product is not delivered within the deadline, you may be charged for product storage and retrying.

9. Risk transfer

The risk of deterioration of the ordered items is imputable to the customer from the delivery moment.

10. Products Property

The customer will acquire products ownership when we receive full payment of the amounts due in respect of them, including shipping costs if applicable.

11. Guarantees

Items delivered to the customer will correspond to those selected on the website, except in cases where a particular article has been manufactured using processes in which there may be slight differences between articles of the same reference.

Pinto Monteiro, Lda informs you that the images in the articles may not correspond exactly to the product supplied in detriment of possible typing errors or due to slight changes by the product manufacturer.

Pinto Monteiro, Lda only sells articles in perfect condition, so if, exceptionally, the customer receives an item with defect, L. Pinto Monteiro will fulfill all obligations under the applicable warranty legislation. In this case, the customer should contact L. Pinto Monteiro, Lda through the indicated contacts and under the conditions of Return Policy.

If the delivered products have anomalies caused by transportation to the delivery address, detected by the customer at the date of receipt, all anomalies and complaints must be mentioned in the carrier’s “Goods Receipt Report”.

12. Prices

The price of each product will be the one stipulated at any time on our website, except in case of obvious error. While we try to ensure that all prices on the page are correct, errors may occur. If we detect an error in the price of any of the products that the customer has ordered, we will inform you as soon as possible and give you the option to reconfirm the order at the correct price or cancel it. If we are unable to contact the customer, the product/order will be canceled.

We will not be required to supply any product at an incorrect lower price if the error in price is obvious and unambiguous.

Prices on this website are in Euros (€) and do not include VAT or shipping costs. Shipping costs will be added to the total amount, according to the order weight/volume.

Prices may change at any time, but possible changes will not affect orders received prior to changes made.

The cash payment option is validated upon receipt of your order by the carrier, which will be responsible for billing.

14. Value-added tax

All purchases made through this website are subject to the current Portuguese Value Added Tax (VAT) rate, except for purchases made in Community and non-Community countries.

15. Returns Policy

Customer has 14 days from the delivery date to make its return. For this purpose, the customer should contact L. Pinto Monteiro, Lda by telephone + (351) 22 485 38 90 or by e-mail: [email protected] and must communicate the “Return Reason” on cause.

Items produced by customer specifications or that are manifestly customized do not give the customer the right to exchange/return.

Pinto Monteiro, Lda does not exchange/return any article that, by their nature, do not allows by hygiene/safety reasons.

The contractual right to exchange/return shall apply exclusively to products which may be returned under the same conditions as the customer received them. No change will be made if the product has been used beyond simply opening of the package or if it has been damaged; therefore, the customer should be careful about the products while they are in their possession. Please return the item using or including the original packaging. It should also include all product instructions, labels, documents and packaging.

  15.1. General Warranty Conditions 

  1. If an anomaly is detected and reported within 14 days of article receipt, L. Pinto Monteiro, Lda authorizes its direct exchange for a new article provided that it is in a good state of repair, duly packaged and if existing anomalies are not the result of misuse.
  2. In cases where there is a rupture of stock, or for other adverse reasons to L. Pinto Monteiro, Lda, the respective credit of equal value will be made.

  15.2.Terms of Loss Right of Return/Exchange

Loss of right of Return/Exchange will occur whenever the following conditions are met:

  1. If the defect is found to have been the result of misuse or in violation of the instruction manual.
  2. When the defect is caused by nature agents or accidents whose liability does not fall within the scope of L. Pinto Monteiro, Lda.
  3. Warranty seal, packaging, or other identifiers of the product removed or violated.
  4. If the purchase invoice of the product(s) in question is not presented.
  5. When the article is not in a good state of repair, showing deformations and defects that indicates misuse or any kind of unforeseen incident.
  6. Returning/exchanging a defective item will incur no cost to the customer as long as it is found to be a production defect.

  15.3. Goods Reception

  1. Goods shipment must be made with the shipment costs paid by the customer (if the article is not defective), in appropriate packaging and properly packed by a carrier under the customer’s responsibility. If the article is defective, the picking and payment of the costs will be responsibility of L. Pinto Monteiro, Lda.
  2. The product is the sole responsibility of the customer (including loss or any other reason) until arrival at the facilities of L. Pinto Monteiro, Lda and its acceptance. After product acceptance the liability is passed on to L. Pinto Monteiro, Lda.
  3. The package must contain exactly the items identified by the customer. The packaging must also contain on the outside all documentation inherent to the properly conditioned return (Transparent Bag) for its verification and acceptance, under penalty of possible refusal.
  4. Any non-compliance detected invalidates the return that will be fully returned with the costs.

  15.4. Free warehouse return 

  1. All orders exchanges and returns must be made within 14 days from the date of purchase.
  2. Deliver the items you want to return or exchange at our facilities, identifying the “Reason of Complaint”. The article must be accompanied with its invoice. If you do not have an invoice for your order, you can request a copy of it by e-mail: [email protected].
  3. When returning the products will be made the respective credit note.

16. Exchange Policy

There are two types of exchanges:

  1. Article exchange for another equal;
  2. Exchange for a different article – In this case you have a maximum of 14 days from the date of receipt of your order to request an exchange of an article.

To begin the exchange process, you should send an email to [email protected], mentioning the invoice number in the subject line of the email. You will need to give us the reasons for the exchange and provide all the necessary elements for the analysis of your order, as well as identify the products you want to receive in return.

    16.1. What follows?

We will then send you a detailed email with the following steps so you can receive the correct article.

Once you receive our confirmation that the exchange has been accepted, you will need to arrange the items pickup by carrier and prepare it to be returned for collection on the scheduled date. You must use the original shipping carton and include all components that are part of the article(s).

The customer will be responsible for the associated shipping costs, except in cases where exchanges are caused by incorrect or damaged items.

17. Intellectual property

Products marketed by L. Pinto Monteiro, Lda are property of L. Pinto Monteiro, Lda or its authorized suppliers and are protected by applicable intellectual property laws.

Unless expressly authorized in writing by L. Pinto Monteiro, Lda, the customer may not copy or reproduce the products ordered and/or purchased from L. Pinto Monteiro, Lda.

18. Harmful Content

You should not misuse this website by introducing technologically harmful content or unauthorized access.

Failure to comply with this clause implies infringements typified by applicable law. We will inform the competent authorities of any law breach and we will cooperate to identity the offender. If you fail to comply with this clause, you will also no longer be authorized to use this website.

If our website contains links to other third party pages and materials, these links are provided for information purposes only, without having any control over the content of those pages or materials. Therefore, we will not accept any liability for damage or loss due to its use.

20. Written Communication

Applicable law requires that part of the information or notifications we send you be in a writing way. By using this website, the customer accepts that most notifications are made electronically.

For contractual purposes, the customer agrees to use this electronic means of communication and acknowledges that all contracts, notifications, information and other notifications sent electronically satisfy the legal requirement that such notices be made in writing.

Customer notifications should preferably be sent via our contact email, as well as we will send them email notifications or for postal address provided.

Notifications will be deemed to have been received, and correctly made, at the same time as the customer enters our website 24 hours after sending an email or three days after the postage date of any letter.

22. Applicable law and jurisdiction

The use of our website and the purchase agreements made through this website are governed by Portuguese law.
